Terms & Conditions — GCMS Reports

When availing the services of GCMS Reports (a filing assistance wing powered by eHouse Immigration Services, Canada), you implicitly agree to the following Terms & Conditions.

1.   No Affiliation with the Government of Canada

“GCMS Reports” and “eHouse Immigration Services” are not affiliated with the Government of Canada, IRCC, CBSA, or any other government agency.

The information we provide is accessed lawfully under the Access to Information Act and the Privacy Act of Canada, based on the consent and authorization you provide.

2.   Handling of Personal Information

• We deliver the GCMS Notes and related files exactly as received from Immigration, Refugees and Citizenship Canada (IRCC), without modification, concealment, or omission.

• Once your file has been delivered to you, in order to protect your privacy, all your electronic/paper copies, which are stored with us, are destroyed/deleted within 30 days.

• All personal information obtained from you is stored, handled, and protected in compliance with:

○ Canada’s Personal Information Protection and Electronic Documents Act

(PIPEDA)

○ EU General Data Protection Regulation (GDPR) (for EU/EEA clients)

○ India’s Digital Personal Data Protection Act (DPDP Act, 2023) (for Indian clients)

3.   Payments

• Payment is collected at “Checkout” before we begin processing your request.

• GCMS Reports accepts major debit and credit cards (Visa, MasterCard, American Express) and other available methods such as PayPal, Apple Pay, or wire transfer (on request).

• All payments are processed through secure third-party payment gateways. By making a payment, you agree to the terms and conditions of the corresponding payment processor.

• All transactions are subject to clearance under applicable banking laws.

4.   Refund & Cancellation Policy

• All payments are non-refundable once processed, as we begin work immediately on your file.

• Exceptions apply only if:

○ We are unable to procure your GCMS Notes due to our error or system failure.

• In such cases, a full or partial refund may be issued at our discretion.

• For EU/EEA clients: By confirming your order, you consent to immediate performance of the service and acknowledge that your 14-day right of withdrawal does not apply once processing begins.

5.   Disputes & Resolution

• We strive to ensure timely and accurate delivery of your GCMS Notes.

• If a dispute arises, both parties agree to first attempt resolution through good-faith negotiation or another appropriate dispute resolution mechanism before resorting to legal action.

• In the event legal proceedings become necessary, these Terms are governed by the laws of Canada, and disputes shall be subject to the exclusive jurisdiction of the federal courts of Canada.

6.   Limitation of Liability

• GCMS Reports acts solely as a filing assistance provider. We do not have any influence on outcomes, visa approvals, or decisions from IRCC or any other government body.

• Our liability for any claim related to services is strictly limited to the amount you paid for the service.

7.   Updates to Terms

● We may revise these Terms from time to time. Updated versions will be published on our website with a new effective date. Continued use of our services after such updates constitutes acceptance of the revised Terms.
